Crumbl® Official Rules for Utah Giveaways (“Official Rules”)

An eligible individual who enters, or attempts to enter, the Sweepstakes hereafter is referred to herein as a “Participant,” “you,” or “your.” By participating in the Sweepstakes, or attempting to enter the Sweepstakes, you unconditionally accept and agree to comply with, and abide by, these Official Rules.

1. Sponsor

This giveaway (the "Sweepstakes") is sponsored by Crumbl Franchising, LLC, a Utah limited liability company ("Sponsor"), whose headquarters are located at 815 W. University Pkwy, Orem, Utah 84058.

Sponsor may offer a similar Sweepstakes from time to time. Each offer is separate. Entry into each Sweepstakes is separate. The start/end time, information on how to enter, and available prize(s) for this Sweepstakes are listed below. The Official Rules may also be found by visiting Sponsor’s website: https://crumblcookies.com/utahgiveaway  (“Sponsor’s Offer”). The other terms below will apply to this Sweepstakes.

2. Eligibility

Open only to legal residents of the state of Utah, who are 18 years of age or older at time of Entry. Void where prohibited by law. All applicable federal, state, and local laws apply. In addition, persons in any of the following categories are not eligible to participate in the Sweepstakes: any person who on the first of the Sweepstakes Period was or is:

a. A Crumbl® restaurant franchise owner or a director, officer, employee, agent, or independent contractor of a Crumbl® franchise restaurant;

b. A director, officer, employee, or agent of Sponsor, its parent company or its respective subsidiaries, or affiliated companies.

c. An owner or employee of Snowbird Resort, Zion Ponderosa Resort, or Conestoga Ranch, or any of their parents, related, affiliated, or subsidiary companies.

d. An immediate family member (defined as spouse, IRS dependent or biological, foster, in-law, adoptive or step-mother, father, sister, brother, daughter, or son, and their respective spouses) of, or anyone who resides in the same household as, any person in any of the preceding categories.

3. Sweepstakes Period

Each sweepstakes will take place during May 23, 2022 (12:01:00 AM) until June 4, 2022 (11:59:59 PM) (“Sweepstakes Period”). Prize Winners will be selected at the end of the Sweepstakes Period.

4. How to Enter

A valid email address or phone number is required to participate. You may enter the Sweepstakes by purchasing a Crumbl party box with a Crumbl® loyalty account, which may include through the Crumbl App or an in-store purchase referencing the Crumbl® loyalty account. To enter the Sweepstakes using the Crumbl App, you will need a Digital Device (defined below) and a valid email address. You must first download and install the Crumbl App on your qualifying iOS or Android Device (e.g., an iPhone, Android phone, etc.) (each a “Digital Device”) if you do not already have the current version of the Crumbl App installed. Data rates may apply. The Crumbl App is free and is available in the App Store or Google Play (for iOS/Android). Once you have downloaded the Crumbl App, complete the registration process by providing a valid email address or phone number, as well as your Crumbl® loyalty account. The winner will be notified via the email address or phone number associated with his or her Entry.

You may be required to upgrade the operating system on your digital device in order to access the latest version of the Crumbl App. If you are using your Digital Device to enter, charges, including message and data rates, may apply. You should consult your wireless service provider regarding its pricing plans, time, toll, connection, and usage rates. Entry does not require a payment or a purchase of any kind.

Entries generated by script, macro or other automated means are void, as are Entries that are illegible, garbled, incomplete or that contain errors. All Entries become the property of the Sponsor. No other entry method will be accepted.

There are two ways to enter the Sweepstakes:

A. During the Sweepstakes Period, an eligible Participant will automatically receive one entry (each an “Entry”) into the Sweepstakes when they use their Crumbl® loyalty account to purchase a party box from any Crumbl® store located in the state of Utah. If by reason of any problem, whether mechanical, technical, due to human error or omission, or other means the order cannot be completed, no Entry will be recorded. You may also submit an Entry by not making a purchase as stated below.

 

B. During the Sweepstakes Period, you may submit an Entry without making a purchase. To receive one Entry without making a purchase, click on this Entry Form link and you will be directed to an Alternative Method of Entry (“AMOE”) form that you must complete by providing your first and last name, email address, phone number, birthday, and checking the box to confirm that you have read and agree to the Official Rules and that you are eligible to enter the Sweepstakes. When you submit the entry form and it is successfully received and recorded by the website servers, that will be the date and time of the submitted AMOE Entry. Proof of transmission is not proof of receipt. AMOE Entries are recorded in MDT, regardless of where you are located. AMOE Entries must be received no later than June 4, 2022, at 11:59:59 p.m. MDT and are subject to the daily limit of one Entry per day.

There is a limit of one Entry per Participant per day (regardless of Entry method (i.e., via a party-box purchase with a Crumbl® loyalty account or via an AMOE Entry) and regardless of the number of party boxes or other purchases that a Participant makes using their Crumbl® loyalty account during any given day). Any subsequent Entry(ies) on the same day will be disqualified and any person submitting purported Entries in excess of the above-stated limit may be disqualified in Sponsor's sole discretion. Participants may not share an email address with any other Participant for purposes of entering the Sweepstakes.

5. Winner Selection; Odds of Winning.

Three potential winners will be selected from among all eligible Entries received for the entire Sweepstakes Period in a random prize drawing on or around June 10, 2022. The drawing will be conducted by an independent committee comprised of the Sponsor’s employees. The odds of winning a prize will be determined by the number of eligible Entries received from all Entry methods combined. The Sweepstakes is open to over 3,500,000 Utah residents. There is a limit of one prize per Participant. Each potential winner may be required to participate in the prize fulfillment process and sign documentation, including a release, as more fully described below, as a condition of being awarded a prize.

The prizes mentioned in Sponsor’s Offer are the only prizes available. No transfer, substitution or cash redemption will be awarded in lieu of stated prize except by Sponsor who reserves the right to substitute a prize (or portion thereof) of comparable or greater value, in its sole discretion, if the advertised prizes becomes unavailable. All prize details are at the sole discretion of the Sponsor. Odds of winning depend on number and timing of Entries received in each Sweepstakes.

6. Notification/Validation

The potential Winner(s) will be notified by the email may be required to execute and return an Affidavit of Eligibility/Release of Liability/Publicity (where legal) form within 7 days of date of attempted notification. If winner is a Minor, all documents must be signed by parent or legal guardian. Noncompliance within this time period, with these Official Rules or the return of any prize/prize notification may result in disqualification and, at Sponsor’s discretion, an alternate potential winner may be selected by Sponsor. Prizes will be fulfilled approximately 3-4 weeks after winner validation. Any winner later determined to be ineligible may be required to return his/her prize. Any taxes on prize are the responsibility of the winner.

7. Prizes

Three prizes are available under this Sweepstakes as detailed below. A Participant is only allowed to win one of the three available prizes. Each prize is comprised of a gift card of a value listed below, which may be used at respective iconic Utah destinations as follows:

 

1. Snowbird Resort. One winner will be given a $1500 gift card redeemable at Snowbird Resort near Salt Lake City, Utah. It can be used for lodging, activities, the spa, gift shop, or wherever else the gift card is accepted. Use of the gift card is dependent on the Snowbird Resort Gift Card policies. 

 

2. Zion Ponderosa Resort. One winner will be given a $1500 gift card redeemable at Zion Ponderosa Resort in Orderville, Utah. It can be used for lodging, food, and excursions such as canyoneering, horseback riding, jeeping, or any other activity located on their premises. Use of the gift card is dependent on the Zion Ponderosa Gift Card policies. 

 

3. Conestoga Ranch. One winner will be given a $1500 gift card redeemable at Conestoga Ranch in Garden City, Utah. It can be used for lodging, food, and any activities such as bike rentals, yoga, or any other expense affiliated with the Conestoga Ranch. Use of the gift card is dependent on the Conestoga policies.

 

8. General Rules

Acceptance of prize constitutes permission to the Sponsor and its designees to use each winner's name, city, state, likeness, voice, biographical information and statements for purposes of advertising, promotion and publicity in any and all media, now or hereafter known, throughout the world in perpetuity without additional compensation, notification or permission, unless prohibited by law. By participating in the Sweepstakes, Participant (i) agrees to release and hold Sponsor, and its parent, affiliates, subsidiaries, and advertising and promotion agencies, and each of their respective directors, officers, employees and assigns (collectively, the "Released Parties"), harmless against any and all claims and liability arising in whole or in part, directly or indirectly, out of participation in the Sweepstakes or misuse, nonuse or use of any prize; (ii) waives all rights to claim punitive, incidental and consequential damages, attorneys' fees or any damages other than actual out-of-pocket costs incurred to enter; and (iii) agrees to be bound by these Official Rules. Sponsor may require each potential winner to sign documentation, including agreement to these Official Rules and the releases mentioned herein, as a condition of being awarded a prize. Participant agrees that Released Parties are not responsible for incomplete, lost, late, damaged, inaccurate, illegible, misdirected, garbled, delayed or undelivered entries or referrals; or for technical hardware or software malfunctions or failures of any kind, lost, unavailable network connections, or failed, incomplete, garbled or delayed computer transmission, which may limit an individual's ability to participate. Sponsor reserves the right in its sole discretion, to cancel, suspend or modify the Sweepstakes, or to disqualify any implicated Participant(s) or entrant(s), (and their Entries) if any fraud, virus, actions by other participants or entrants, technical or other error or problem, or any other occurrence corrupts or affects the administration, integrity, security, or proper play of the Sweepstakes, as determined by Sponsor in its sole discretion. In the event of cancellation, Sponsor reserves the right, at its sole discretion, to award the prize in a random drawing from among all eligible, non-suspect Entries received up to the time of the event or action warranting such cancellation. In the event the Sweepstakes is canceled prior to the stated end date, a notice will be posted at https://crumblcookies.com/utahgiveaway. Sponsor reserves the right to seek damages from any such Participant to the fullest extent permitted by law if any attempt by a Participant is made to deliberately damage any web site or undermine the legitimate operation of the Sweepstakes. In the event a dispute arises regarding a specific individual entitled to receive a prize, Entries will be declared made by the authorized account holder submitted at the time of Entry and any damage made to the web site will also be the responsibility of the authorized account holder. "Authorized account holder" is defined as the person who is assigned to an App or email, as the case may be. Released Parties are not responsible for any technical, mechanical, printing, typographical, human or other error relating to or in connection with the Sweepstakes, including, without limitation, errors which may occur in the administration of the Sweepstakes, the processing of Entries, the announcement of the prize or in any Sweepstakes-related materials; or for any liability for damage to any computer system resulting from participating in, or accessing or downloading information in connection with this Sweepstakes.

9. No Warranties

Sponsor makes no warranties covering any of the prizes furnished as part of this Sweepstakes. Any prize, and all materials furnished as part of or in connection with this Sweepstakes are provided "as is" without warranty of any kind, either express or implied, including without limitation the implied warranties of merchantability or fitness for a particular purpose.

10.  Choice of Law

This Sweepstakes and the rights and obligations of the Sponsor and Participants will be governed by and controlled by the laws of the State of Utah, applicable to contracts made and performed therein without reference to the applicable choice of law provisions. All actions, proceedings, or litigation relating hereto will be instituted and prosecuted solely within the State of Utah, County of Salt Lake. The parties consent to the jurisdiction of the state courts of Utah and federal court located with such state and county with respect to any action, dispute, or other matter pertaining to or arising out of this Sweepstakes.

11.  Privacy

Winner’s name and contact information will be used in order to contact winner for the purpose of fulfillment of prizes. Any information submitted to Sponsor, including all Entries will be governed by the terms of Sponsor’s User Agreement and Privacy Policy.

12.  No Implied Endorsement

The names of individuals, groups, companies, products and services mentioned herein, and any corresponding likenesses, logos and images thereof reproduced herein, have been used for identification purposes only and may be the copyrighted properties and trademarks of their respective owners. The mention of any individual, group or company, including Snowbird Resort, Zion Ponderosa, or Conestoga Ranch, or the inclusion of a product or service as the prize, does not imply any association with or endorsement by such individual, group or company or the manufacturer or distributor of such product or service and, except as otherwise indicated, no association or endorsement is intended or should be inferred.

13.  Winner’s Name

The name of winners (first name / city) may be posted on the Sponsor’s website, email marketing, and/or social media accounts.
